NEW HAMPSHIRE LOTTERY MOBILE APPLICATION TERMS & CONDITIONS AND MY603REWARDS PROCEDURES
Please read the terms and conditions of this License Agreement (hereinafter, the "Agreement") carefully before using the New Hampshire Lottery Mobile Application (hereinafter, the "App") or taking part in the My603Rewards Program (“Program”). Any software, data, integrations, features, content or information made available as part of the App or Program shall hereby collectively be referred to herein as the App and Program. The App and Program are offered for your use only and are subject to the Agreement in its entirety. Your use of the App and Program confirm your understanding and acceptance of the terms of this Agreement, the iLottery Terms and Conditions, and the Privacy Policy, and any changes to the Agreement or above noted terms, published hereafter.
Third Party Services.
The New Hampshire Lottery does not charge any fees in association with the downloading, installation, or use of this App or Program. Likewise, the New Hampshire Lottery is not liable for any hardware, software, connectivity or any other fees that you incur as a result of using the App and Program. Your use of the App and Program is subject to your agreement with your mobile phone service provider, internet connectivity provider or other service provider related to your device. Any charges related to content, data or downloads are subject to your price plan and usage as outlined in your agreement with any applicable service provider.
Limited License.
Subject to the Agreement, the New Hampshire Lottery grants you a license for your individual, private, non-commercial use of the App and Program for the device with the original download and installation of the App, subsequent downloads, updates and registration for the Program.
Prize Claims and Wagers.
The information made available through the App and Program does not constitute a legitimate wager or claim for prize payment. Only an official wager purchased at a New Hampshire Lottery Retailer, or through NH iLottery via money mode, constitutes a valid wager. All valid claims are subject to inspection and verification by the New Hampshire Lottery.
Age Restrictions.
While the App and Program does not have any content that is age-restricted, the New Hampshire Lottery and the State of New Hampshire does not authorize the purchase of New Hampshire Lottery products for any person under the age of 18.
Liability.
The use of this App and Program is provided on an "as is" and "as available" basis, and without any warranty of any kind or nature. The New Hampshire Lottery does not warrant that use of this App and Program will be uninterrupted, fault-tolerant or error free. There are no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, accuracy, correspondence with description, satisfactory quality or non-infringement.
You further agree that in no event will the New Hampshire Lottery be liable for any damages including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages or expenses, arising from this App and Program, its installation and use, inability of use, failure of performance, error, omission, interruption, defect, malfunction, delay of operation, or loss of service on your device. This includes any damage to a mobile phone, its associated software, or any other application previously installed to the device.
Unauthorized Use.
The New Hampshire Lottery is not liable for any damages or losses resulting from a third party’s unlawful or unauthorized use of your account. If your username and password were entered correctly, the New Hampshire Lottery is entitled to assume you are the person using your account. You are responsible for any charges, costs, expenses, damages, liabilities, and losses of any kind that you, the New Hampshire Lottery, or any third party may incur as a result of your failure to keep your account information confidential. It is your responsibility to immediately notify the New Hampshire Lottery if you suspect or discover that your account has been compromised. You agree to cooperate with any investigation into unauthorized access of your account.
Updates.
The New Hampshire Lottery may offer automatic or manual updates to this App or Program at any time and without notice to you. These updates are also subject to termination with or without notice to you.
Illegal Use.
You may not use the App or Program for any illegal purposes, The New Hampshire Lottery reserves all further rights. You do not acquire any intellectual property rights, or other rights in the App or Program, as a result of downloading the App or registering for the Program.
Restrictions on Use.
This App and Program or its content may not be reproduced, duplicated, copied, sold, resold, reverse engineered, or otherwise exploited for any commercial purpose without the New Hampshire Lottery's express written consent. You may not frame, or utilize framing techniques, to capture or display any portion of this App, the Program, or its content without the New Hampshire Lottery's express written permission. Any unauthorized use of this App or the Program may result in criminal prosecution, civil penalties, or both.
Communications.
By downloading the App, you agree to receive push notifications to your mobile device, which may be automated and could include, but is not limited to, jackpot alerts, new game announcements, promotions, coupon offers, and surveys. You may opt-out of receiving push notifications by updating “notifications” on your device under “Settings.”
Privacy.
The New Hampshire Lottery, its contractors, vendors and designated agencies, may collect and use technical or other information relating to this App or Program, and may share this information with others for product support, statistical reporting, or any other purposes consistent with applicable data protection laws. Any personal information provided by you or collected in association with your use of the App and Program are subject to the then current version of the New Hampshire Lottery Privacy Policy (https://www.nhlottery.com/Privacy-Policy).
The New Hampshire Lottery in no way guarantees that any information you submit though this App or Program will remain private. In no event will the New Hampshire Lottery be responsible for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages or expenses arising from the intentional or unintentional disclosure of such information to any third party.
Trademarks.
Content included on this App and in the Program, such as text, images, photos, logos, buttons, icons, screen savers, audio clips, digital downloads, data compilations, and software is the property of the New Hampshire Lottery or its content suppliers and is protected by United States and international trademark, copyright and intellectual property laws. You may not use any text, images, photos, logos, buttons, icons, screen savers, audio clips, digital downloads, data compilations, graphics, page headers, scripts, or software, without the express written permission of the New Hampshire Lottery and, where appropriate, the content provider. Any unauthorized use of such content may result in criminal prosecution, civil penalties or both.
Termination.
The New Hampshire Lottery may, at any time and in its sole discretion, terminate, remove, disable access to, block, or modify this App or the Program for any reason and without notice. In no event will the New Hampshire Lottery be responsible for any damages including, without limitation, direct, indirect, incidental, special, consequential, or exemplary damages or expenses arising from the termination, removal, restriction of access, blocking, or modification of this App or Program.
My603Rewards.
In order to participate in the "My603Rewards" Program functionality of this App, the Lottery may require that you provide specific "personal information" to the Lottery in the manner prescribed by the Lottery in order to establish or maintain an account. You may not maintain more than one account. The Lottery reserves the right to delete or close any account, or all accounts, at any time for any reason, including, but not limited to, the existence of multiple accounts for one individual. In order to establish an account, you must be eighteen (18) years of age or older and a “US Person” as defined by 26 US.C. sec. 7701 (a)(30).
Registration and participation for the Program requires player authentication, that includes a Know Your Customer (KYC) check, which requires registrants to provide the last four digits of their Social Security number, as well as other Personally Identifiable Information, including birthdate, gender and home address. To participate in Second Chance Drawings, My603Rewards, ticket scanning or any other action within the App or My603Rewards, a player must use the NH Lottery mobile App and the camera on their smart device. If a player does not have access to an up-to-date mobile device with camera, a player cannot participate in these activities.

Optical Recognition Use.
This App and Program may allow certain features of your device, such as the camera or a barcode reader, to quickly gather game information from a New Hampshire Lottery ticket, wager, promotion, coupon, advertisement piece, receipt or other form of media. In no event will the New Hampshire Lottery be responsible for any damages, including, without limitation direct, indirect, incidental, special, consequential, or exemplary damages or expenses arising from the erroneous entry of information, whether by a user, feature of your device, or by the App's optical character recognition program. It is your sole responsibility to ensure that any information entered into this App or the Program is accurate and disclaim any reliance on inaccurate or incomplete information, however entered.
Applicable Law.
The use of this App, the Program, the Agreement, and any dispute regarding the Agreement, will be governed by and interpreted under the laws of the State of New Hampshire. Accordingly, any litigation regarding this App, the Program, or the Agreement must be brought in the courts of the State of New Hampshire. Your acceptance of this Agreement will be considered as your giving irrevocable consent to jurisdiction in the State of New Hampshire.
If any provision of the Agreement is held unenforceable, the provision will be modified to reflect the intent of the Agreement where possible, or struck, if modification is not possible. All remaining provisions will remain in full force and effect.
Safety.
Please do not endanger yourself and others by using the App or the Program while driving or engaged in any other activity that requires your attention.
Changes to Terms.
The New Hampshire Lottery may, at any time and at its sole discretion, modify the Agreement for using this App or the Program. Any such modification will be effective upon posting in the terms and conditions section of this App, without any special notice of such changes. You are solely responsible for reviewing the Agreement before use, and any continued use of this App or Program, as your acceptance of any modification to the Agreement.
Content.
The information available through this App and Program is for entertainment purposes. While every attempt for accuracy is made, the information displayed on this App and in the Program may not be accurate and is such cases will have no legal force or effect. A claim may not be premised on human, electronic, or other error in the communication, display or transmission of data, however recorded, displayed or transmitted, nor premised upon any intentional human, electronic or other form of communication or transmission of data that has not been authorized by the New Hampshire Lottery. You are solely responsible for verifying any winning number information related to a valid New Hampshire Lottery wager and hereby disclaim any reliance on the information displayed in this App.
Every effort has been made to ensure the accuracy of winning numbers and prize payouts. In the event of a discrepancy, the official and certified files maintained by the New Hampshire Lottery Commission shall prevail.
Neither the State of New Hampshire, nor any agency, officer, or employee of the State of New Hampshire warrants the accuracy, reliability or timeliness of any information published by this system, nor endorses any content, viewpoints, products, or services linked from this App and Program, and shall not be held liable for any losses caused by reliance on the accuracy, reliability or timeliness of such information. Portions of such information may be incorrect or not current.
Any person or entity that relies on any information obtained from this App and Program does so at their own risk. Any lawsuits filed against the New Hampshire Lottery Commission or the State of New Hampshire shall be filed in Concord, New Hampshire. Any user who accesses this App and Program agrees to all terms and conditions stated.
Account Deletion.
To delete your account, you must contact the Player Support Center. Read through the Delete My Account section for further information on how to delete your account. Note, that once a My603Rewards/NH iLottery account is deleted, a new account cannot be opened for the same person. You will no longer have access to your account and any Rewards Points, Second Chance Entries, digital Lottery Cash or Coupons will not be retrievable, usable, and/or eligible for prizes.
My603Rewards Program and Procedures.
The Program is a loyalty program through which qualified individuals (“Participants”) can collect points (“Points”) by submitting non-winning tickets and/or by performing actions in the App. Participants may use their Points to participate in drawings and redeem for Lottery Cash and Coupons. The Program is administered by Marcus Thomas, LLC in collaboration with the New Hampshire Lottery Commission.
- Participation Eligibility. The following individuals are NOT eligible to participate in the Program: (a) employees of the New Hampshire Lottery Commission (“NH Lottery”); (b) employees of NH Lottery’s vendors and contractors; (c) employees of any other person or entity involved in the development, administration, or execution of the Program; and (d) the immediate family members (parent, child, sibling and/or spouse of each) living in the same household as persons set forth in items (a) through (c) above.
- Account Registration. To enroll, a Participant must click on the "Sign Up" button in the Rewards section of the NH Lottery App and follow the onscreen instructions to create a My603Rewards account ("Account") or log-in using an existing My603Rewards or NH iLottery Account. An individual must have a unique valid e-mail address to create an account. Limit one (1) Account per person. Limit one (1) account per e-mail address, regardless of whether more than one person uses the same e-mail address. The person who is the authorized e-mail account holder of the e-mail address indicated when registering (and who otherwise meets the eligibility criteria) will be deemed the Participant. Once Participants register their existing Account or register for a new Account, they will be enrolled in the Program.
- Participant Accounts are for individuals only. Corporations, associations, school organizations and other groups may not participate in the Program.
- Participants are responsible for maintaining updated contact information. This can be done by logging into NH iLottery and clicking on your name in the Player Details section, then updating the information as necessary, or by contacting the Player Support Center. Failure to keep Account updated may result in forfeiture of prizes.
- Limit of two (2) unique accounts per household. More than two accounts per household may forfeit eligibility.
- The Lottery reserves the right to request valid identification from Participants, including, but not limited to valid state or federal government issued identification.
- Collecting Points. Participants collect points by scanning active non-winning tickets and by participating in pre-defined activities. Points collected are recorded and tracked and can be found on Participants’ My Account page.
- Time Period.
- Points are collected on a monthly basis.
- Each month is defined as 12:00AM Eastern Time on the first day of the month through 11:59:59PM Eastern Time on the last day of the month.
- There is a monthly limit for point collection, and it applies to all months regardless of there being 28, 29, 30 or 31 days.
- Non-Winning Tickets.
- Scratch Tickets. Under the “Scratch to Cash” on scratch tickets is a barcode. This barcode must be scanned by the App. If eligible (non-winning ticket in an active status with no active Second Chance Drawing associated with it), the ticket will be eligible to collect Points.
- Terminal Games. At the bottom of terminal based games, including Keno 603, Fast Play, all draw games, is a scannable barcode. This barcode must be scanned by the App to earn points. If eligible (non-winning ticket, with all draws complete with no active Second Chance Drawing associated with it), the ticket will be eligible to collect Points.

- The Lottery reserves the right to change the number of Points collected for tickets, to increase or decrease the Monthly Point Collection Cap, or to remove games from eligibility to collect Points at any time

- Pre-defined Activities.
- On occasion the Lottery will set parameters that may allow Participants to collect additional Points. This may include logging in for consecutive days, scanning certain tickets, doing certain actions.
- The Lottery is under no obligation to provide Pre-defined Activities collecting opportunities and can commence and terminate any Pre-defined Activity at any time.
- Points collected for pre-defined activities may permit Participants to exceed the Monthly Point Collection Cap as these activities are not always based on the scanning of non-winning tickets.
- Participant Account. Points will be added to Participant Accounts in real-time, as non-winning tickets are scanned. Each Participant has the responsibility of ensuring their Points are properly credited.
- NH Lottery reserves the right to invalidate Points from an Account if it determines that Points were improperly credited to an Account or obtained improperly.
- If a Participant believes that Points were not credited accurately, they must email My603Rewards@lottery.nh.gov and a response will be provided within three (3) business days. Inquiries must be received within five (5) business days of when Participant believes Points were credited incorrectly.
- Ineligible Barcode. If a barcode is unscannable due to damage, the Participant must email My603Rewards@lottery.nh.gov for assistance. The Lottery does not guarantee Point collection for damaged tickets.
- No Cash Value or Transferability. Points do not constitute property, do not entitle a Participant a vested right or interest and have no cash value.
- Points are not redeemable for cash, transferable or assignable for any reason, and are not transferable upon death, as part of a domestic relations matter or otherwise by operation of law. The sale of Points is strictly prohibited.
- Any Points remaining in a Participant’s Account that has been inactive (no log-in, no accrual or no redemption) for 365 days will be forfeited without compensation. There shall be no carryover or transfer of Points to other NH Lottery programs unless otherwise determined by NH Lottery in its sole and absolute discretion.
- Points provided under the My603Rewards Program, in accordance with all Terms & Conditions and My603Rewards Procedures, are provided by the NH Lottery free of charge to Participants. These Points may be used only for participation in the My603Rewards.
- Redeeming Points. Participants can redeem Points collected through Redemption Central within the Redeem Points button in the Participants My603Rewards account.
- Participants may redeem Points as soon as they collect enough points to enter a drawing or to redeem for Lottery Cash and Coupons. The total number of Points a Participant can use in Redemption Central is the number of Points available in their Account.
- To redeem Points, click on the “Rewards” star icon, log-in, then click “Redeem Points” and choose if you would like to enter your Points into a Drawing or to redeem for Lottery Cash & Coupons.
- Drawings. The Lottery offers various drawings for Participants to enter. There is no minimum or maximum number of entries for a Drawing. If a Participant has Points, they may enter. A Participant can only win one time per Drawing type.
- Lottery Cash & Coupons. The Lottery adds new Lottery Cash & Coupons to Redemption Central each business day at various time periods. The Lottery provides no warranty on the number of Lottery Cash and Coupons or that they will be available to Participants.
- Lottery Cash. Participants redeeming Lottery Cash must do so in one transaction. One transaction may contain various tickets and price points of Lottery games. However, if the Lottery Cash is for $25, a total of $25 must be used in one transaction or the remaining balance is lost. No change is to be given for any remaining balance.
- Lottery Coupons. Coupons are for pre-defined games, draws and price points. Once scanned, the ticket(s) will automatically print with an Easy Pick or designated game per the Coupon rules.
- Lottery reserves the right to modify the list of items available in Redemption Central, as well as their corresponding Point values, at any time for any reason.
- All Point redemptions are final, and Points will be deducted immediately from a Participants Account.
- Items redeemed may be subject to Federal and State taxes. Marcus Thomas LLC or the NH Lottery will withhold required applicable minimum Federal taxes and issue withholding forms for taxable prize amounts of $600 and greater. Payment of all taxes is the responsibility of the Participant.
- Limitation of Liability.
- Marcus Thomas, LLC, the New Hampshire Lottery Commission, and their respective parent companies, vendors, contractors, subsidiaries, and promotional and advertising agencies are not responsible for any printing or computer error, omission, interruption, irregularity, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alteration of App or Program materials or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of App or Program information due to technical problems or traffic congestion on the internet, at any web site or any combination thereof. In the event that online access is temporarily corrupted and suspended, notice of such will be provided at the NH Lottery App and Participants will be advised to hold tickets until such time that the Program, as originally intended, may be resumed.
- By using the App and participating in the My603Rewards Program, each Participant accepts all responsibility for, and hereby releases and agrees to indemnify and hold harmless Marcus Thomas, LLC, NH Lottery and their respective parent companies, subsidiaries, contractors, vendors, agents, promotion and advertising agencies, and each of their respective officers, directors, Commissioners, employees, members, and successors, assigns, and service providers from and against any claims, liabilities, damages, or expenses that may arise from actions taken by such Participant and/or Participant’s participation in the App or Program, or for any harm or injury caused by any third party.
- UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL MARCUS THOMAS, LLC, NH LOTTERY AND THEIR RESPECTIVE OFFICERS, DIRECTORS, COMMISSIONERS, EMPLOYEES, MEMBERS, AGENTS, CONTRACTORS, VENDORS, SUCCESSORS, ASSIGNS, AND SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF PARTICIPATION IN THE PROGRAM OR ANY DRAWING EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. IF MARCUS THOMAS, LLC. IMPROPERLY DENIES A PARTICIPANT ANY ENTRY/PLAY, LIABILITY WILL BE LIMITED TO ANOTHER ENTRY/PLAY IN A DRAWING IF TIME PERMITS. BY PARTICIPATING IN THE PROGRAM, A PARTICIPANT WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.
- Marcus Thomas, LLC, NH Lottery and their respective officers, directors, Commissioners, employees, members, agents, vendors, contractors, successors, assigns, and service providers, are not responsible for any products or services offered on the Web Site. TO THE FULLEST EXTENT ALLOWABLE BY LAW, MARCUS THOMAS, LLC. AND NH LOTTERY SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE PRODUCTS AND/OR SERVICES SOLD THROUGH THE PROGRAM, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
- A special promotion shall in no way alter the current Terms & Conditions, regulations, and directives pertaining to lottery tickets except as provided herein. All tickets, transactions, and claims are subject to the laws of the State of New Hampshire, these My603Rewards Procedures and all Terms & Conditions, regulations and directives of the Lottery, and any changes thereto. All decisions made by the Commission including the declaration of prizes and payment thereof shall be final and binding on every person making a claim in respect thereof.
